A workshop (hybrid) took place at Nagoya University Graduate School of Law, titled “Cross-Border Legal Aspects of Digital Platforms,” on May 27th (Monday).

Moderators: Professor Dai Yokomizo, Professor Yoshiko Naiki 

During the workshop, Professor Alain Strowel (Professor at UCLouvain, Munich IP Law Center, University of Alicante (IP Master)) presented his research on the topic: “EU Regulation of Online Platforms: Will the Digital Services Act and the Digital Markets Act have cross-borders effects?” leading to an enthusiastic discussion among others on relationship of both acts. 

Professor Ching-Fu Lin (Professor of Law at National Tsing Hua University) presented his research on the topic: “Digital Platforms and AI: The Roles and Limits of the Transparency Principle,” followed by a lively exchange of ideas on defining the transparency principle, as well on difference between AI’s safety issues and AI’s risk related issues.

As a result of the workshop, collaboration with scholars from the EU and Taiwan highlighted the potential for joint research on digital platforms. Plans are underway for future in-person or hybrid workshops and symposiums, fostering active research exchange. This workshop served as a vital forum, creating opportunities for future research endeavors.

　2024年5月27日（月）、「Cross-Border Legal Aspects of Digital Platforms」と題したワークショップ（ハイブリッド）が開催されました。

　当該ワークショップでは、ルーヴァン・カトリック大学のAlain Strowel教授および台湾国立清華大学のChing-Fu Lin教授が、デジタルプラットフォームの渉な法的側面に関する研究活動について報告し、その後、熱心な議論が展開されました。

　Alain Strowel教授は、オンラインプラットフォームに関する EU の規制について報告し、デジタルサービス法（Digital Services Act）とデジタル市場法（Digital Markets Act）には渉外的な影響があるのかという問題を取り上げました。報告後は、両法による「ブリュッセル効果」の可能性や両法の対立関係等に関する議論が行われました。

　Ching-Fu Lin教授は、デジタルプラットフォームと AIの関係において透明性原則の役割と限界という問題を取り上げました。報告後は、透明性原則の定義やAI の安全性問題と AI のリスク関連問題の違いやその他の問題に関して活発な討議が行われました。

　ワークショップの結果、EUおよび台湾の大学との協力により、デジタルプラットフォームに関する共同研究の可能性について確認されました。今後、対面またはハイブリッド形式でより活発な研究交流が期待されます。今回のワークショップは、将来の研究展望を開く重要な機会となりました。
